TERMS AND CONDITIONS

We’re so delighted to host you at Black & Light Studio. We pride ourselves in providing a fresh, inspiring, and safe venue for you to create. We know it’s a lot to read, but please take a moment to review these standard policies so all can fully enjoy the Studio space and have a dazzling experience.

Black & Light Studio (Venue / Owner) agrees to rent the premises (agreed upon booking) to Renter for any future agreed-upon reservation date and beginning/end times booked and paid for in advance. Renter includes all his/her associates, clients, guests, persons, and animals utilizing the Studio.
 


Both parties agree to keep, perform, and fulfill the promises, conditions, and agreements expressed below:

RESERVATION:

Rental time begins promptly at the designated starting time and ends promptly at the designated ending time. Reservation time must include set up, break-down, and clean up. The Studio must be cleaned and vacated by the end of the rental period to respect each Creative’s time and efforts. Set up and breakdown times must fall within the total reservation period reserved. It is the responsibility of Renter and its Vendors to set up, breakdown, and move equipment and other items within the Studio.

OVERTIME CHARGES:

Please start and end your reservation on time. An overtime fee will be automatically be charged to the card on file at a rate of $10 for every 5 minutes over the original reservation end time. This overtime charge applies to all guests/clients in your reservation. This also applies to reservation start time, you may arrive up to 10 minutes early, we ask you to be mindful of the reservation wrapping up ahead of you. If you arrive more than 10 minutes ahead of schedule, the card on file will be charged the overtime fee rate listed above. 


 

CANCELLATIONS:

We understand the need for flexibility when “life happens”. Creatives can reschedule/cancel reservations up to 24 hours prior to start of rental period and receive credit to use towards a future rental with no additional charge.

 

We do not offer refunds for cancellations; this credit will expire in 90 days. We do not offer credits or refunds for reschedules/cancellations less than 24 hours from start of rental period. Please note, this includes reschedules/cancellations for any reason including the photographer's client having cancelled their shoot and cancellations due to illness including Covid-19.

 

Please note - 4-HR, 6-HR or 8-HR reservation hours cannot be split up and used separately.

UNUSED HOURS:

We ask that you only book the number of hours needed when making your reservation an hourly or day reservation. We do not offer partial refunds for unused hours. This pertains to the 1, 2, and 3-HR reservations as well as the 4, 6, and 8-hour packages. The reason being, you have booked that slot making it unavailable for others to reserve. If you wish for more flexibility, consider purchasing the 10 or 20-hour bundles, as you have several months to use them as needed.

WE'RE OFFICIALLY A 'BOOTIE' FOOT COVERING - or - NO SHOE ZONE

Help keep the studio safe and ultra-delicate white floors scuff-free. We’ve designed an ultra-white environment to reflect the natural light and produce an illuminated environment. Keeping the floors white is definitely a challenge, one we're happy to take on, but we need YOUR help. 

•    Please REMOVE shoes by the front door – or – use provided shoe coverings
•    Clients that are photo-ready can keep shoes on
•    Please carry / pick up furniture rather than drag them, the painted concrete is super persnickety and scuffs easily. 
•    Use the provided furniture dollies to help with heavier items.
•    Close the rolling shades at the end of your session (select 0 then the down arrow). 
•    When exiting, make sure the front door FULLY closes.


WHAT HAPPENS IF MY SHOOT ENDS EARLY?

We ask that you only book the number of hours needed when making your reservation an hourly or day reservation. We do not offer partial refunds for unused hours. This pertains to the 1, 2, and 3-HR reservations as well as the 4, 6, and 8-hour packages. The reason being, you have booked that slot making it unavailable for others to reserve. If you wish for more flexibility, consider purchasing the 10, 20, or 30-hour bundles, as you have several months to use them as needed

CLEANING:

We ask that you assume responsibility for returning the studio to its original condition and be courteous of those using the studio before and after you. This includes but not limited to discarding trash, props returned to original locations, and messes cleaned up. Renter agrees to dispose of smaller trash items in the provided trash cans, discard larger bulkier trash items in the back parking lot dumpster and clean up any messes that occur during their rental period.

 

Pets are allowed in the studio but should enter on a leash or in a crate. We do ask that you bring appropriate cleaning supplies for any messes or hair left by the pet. As such, your card on file will automatically be charged $500 for any excessive pet hair on furniture or pet messes left in the studio. It is 100% your responsibility to check for and clean up any accidents - although they shouldn't happen, considering your pet should be on a leash or in a crate.

 

If the Studio is not in the same condition when rented, Renter agrees to pay, as applicable a minimum of a $100 cleaning fee (based on the amount of time required to clean the Studio at a rate of $100 per hour).

 

 

RESPONSIBILITY AND DAMAGES TO PROPERTY:

Upon first accessing the Studio, if Renter ascertains damage to any of the furnishings, equipment, or Studio we should be aware of, please contact us immediately via phone or text (972) 810-1744. We strive to provide both a beautiful and functional set for you at all times.

 

YOU BREAK IT YOU BUY IT POLICY: 

Renter and its clients agree to maintain the Studio, restroom, furniture, props, and all equipment within the premises in as good a condition as they were at the beginning of the rental term. Renter and its clients are 100% responsible for any damage to the Studio, including spills, scratches, excessive wear, marks, or stains on furniture, fixtures, floors, or painted surfaces. Renter and its clients are responsible for caring for all furniture and props in the Studio. Renters card on file will be charged for the cost of damages incurred during the reservation. 

Renter agrees to dispose of smaller trash items in the provided trash cans, discard larger bulkier trash items in the back parking lot dumpster and clean up any messes that occur during their rental period.

Renter will be held financially responsible for any damage to property and furnishings, legal actions, or loss of reputation or business opportunities that Studio may incur as a consequence of the actions of Renter or any of Renter's clients, guests, or visitors while Renter is in control of the Studio, and shall indemnify and hold harmless the Venue / Owner against any and all legal actions which may arise from Renter's use of the Studio.

If Studio Owner claims and provides evidence that Renter or its Clients have damaged any property, furnishings, or fixtures in the Studio, the Venue / Owner is entitled to seek reimbursement via payment for item(s). Renter will be given an opportunity to respond and provide evidence otherwise. Venue / Owner reserves the right to collect payment from Renter and pursue any remedies.

PERSONAL PROPERTY:

Black & Light Studio shall not be responsible for any loss or damage to personal property placed in or about the Venue belonging to Renter or their associates, agents, subcontractors, guests and Renter shall hold Venue / Owner harmless from all claims arising out of loss or damage to such property or props. Venue / Owner shall not be liable for any damage or loss to said property regardless of how and where the same shall occur.

SECURITY AND MONITORING:

In order to help promote the safety and security of its Renters and property, Renter understands and agrees that Black & Light Studio may conduct video surveillance of any portion of its premises at any time, the only exception being the private restroom, and that video cameras will be positioned in appropriate places within and around the building and its common areas.

LIABILITY:

This agreement releases Venue / Owner from all liability relating to physical injuries and/or injury to Renter’s equipment that may occur during any future rental period agreed upon between Venue / Owner and Renter. Renter agrees to hold Venue / Owner entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence.


Any disputes arising under this contract shall be adjudicated in the Venue / Owner’s local jurisdiction.

 

 

RESTRICTIONS:

The Studio reserves the right to terminate the reservation immediately without refund if any of the activities listed below occur:

 

  • No Shoes on white floor. Use studio-provided show coverings or wear socks, barefoot is OK.

  • Nude photography, videography, and explicit sexual activity are strictly prohibited. Please note: Tasteful boudoir photography is permitted, please be mindful the Studio has large windows facing public view to allow natural light in the space and is located in a shared commercial buildings along with other tenants.

  • No smoking or vaping allowed within 25 feet of all entrance, exits, windows, and air take vents.

  • No recreational or illicit drugs.

  • No alcohol shall be consumed by Renters and associates under the age of 21.

  • No glitter, paper confetti, fake snow, smoke bombs

  • No fire, however, Renter may use unlit candles

  • No fireworks

  • No loud music above 60 decibels (must not be audible beyond the walls, doors, and windows of the Studio).

  • No affixing anything to walls or rolling backdrops including nailing, hanging or taping (painters tape is OK)

  • All children and pets must be supervised at all times.

  • The renter may not sublease the Studio to any third party.
